Terms and Conditions

These terms apply to all purchases, pickup and shipping services from Harley’s Enzo.

1. Who we are

Harley’s Enzo is the trade name of Enzo Industries, based in the United States.

2. Scope

These terms apply to every offer, sale, pickup order and shipment arranged through Harley’s Enzo.

Different arrangements only apply if they have been confirmed in writing, for example by WhatsApp or email.

3. Offers and conclusion of the contract

Offers on the website and on social media are without obligation as long as the vehicle has not been sold.

A sale is concluded once you have received an invoice and paid it.

4. Prices

The stated price includes shipping to the port of Rotterdam, the Netherlands.

Not included are the costs that arise after arrival: unloading the container, the customs declaration, import duty and VAT, and any transport from Rotterdam to your address. Duty and VAT depend on the vehicle and your country.

Prices are set in US dollars. Exchange rate differences are for the buyer’s account.

5. Payment

You first receive an invoice. Payment is made to the US business account of Enzo Industries, not to a personal account.

The vehicle is only booked for shipping once payment has been received.

6. Cancellation and refunds

You can cancel. The amount paid is refunded minus the actual bank fees of the transfers.

Transport costs already incurred are also refunded. Only the bank fees of the transfers are not refunded. If you are not satisfied with the bike when you collect it from the shipping agent in the Netherlands, you get your money back, including the transport costs. In that case too, only the bank fees of the transfers are not refunded.

7. Condition of the vehicle

All vehicles are used and are sold in the condition they are in, including visible and hidden signs of use that come with their age.

A video is made of every vehicle beforehand, showing it all round and being started. This video forms part of the description.

For every vehicle you receive a damage report or Carfax before you buy.

8. Shipping and delivery time

Stated sailing times are indicative: about four weeks from New York and about two months from Los Angeles.

Delays caused by the shipping line, weather, customs or port handling do not give a right to cancel the contract or to compensation.

As soon as the vehicle is sold and loaded, you receive the container number.

9. Insurance

Sea transport is covered by transport insurance.

Report any damage that occurs during transport immediately on arrival, before the vehicle is handled further.

10. Arrival in the Netherlands

After arrival, the container is taken to the unloading company within a few days. That company handles the unloading and customs clearance.

For the customs declaration the unloading company needs a power of attorney and a copy of your ID.

The costs of unloading, the customs declaration, import duty and VAT are for the buyer’s account.

11. Documents

You receive the Title and the customs papers, which you need to register the vehicle.

Registering the vehicle in your country, the inspection and any modifications to the vehicle are the buyer’s responsibility.

12. Registration and inspection

Registration rules differ per European country. In the Netherlands, for example, vehicles from 2005 or older can be presented at a regular RDW inspection station, while vehicles from 2006 onwards are inspected at RDW Lelystad.

On request we can put you in touch with partners in the Netherlands who handle the inspection and Dutch registration. The costs of inspection and registration are for the buyer’s account.

Harley’s Enzo provides information about this process to the best of its knowledge, but is not responsible for the outcome of an inspection or registration.

13. Liability

The liability of Harley’s Enzo is limited to the invoice amount of the vehicle concerned.

Harley’s Enzo is not liable for consequential damage, lost income or costs caused by delay.

14. Governing law

This agreement is governed by Dutch law.

Disputes are submitted to the competent court in the Netherlands.
